The eight leaders are now being tried at Rae Bareilly for various offences under Sections 147, 153A r/w 149 and 153B of IPC.
"What they (Supreme Court) have said today means there's clinching evidence that needs to be now argued out in the court", said party spokesman Sanjay Jha. "Why should leaders like Uma Bharti resign from Union Minister position, these all are baseless charges", BJP spokesman GVL Narasimha Rao told a news channel.
Others who will face criminal conspiracy charges are Vinay Katiyar, Sadhvi Ritambara, Satish Pradhan, Champat Rai Bansal.
